ARTIFICIAL INTELLIGENCE IN MARKETING

From 2 August 2026, a company that publishes a realistic image, audio recording or video generated by AI (a deepfake), or AI-generated text on matters of public interest without genuine human editorial control, must label it clearly, as required by Article 50 of the EU regulation on artificial intelligence (the AI Act). Not every piece of content created with the help of AI needs a label. We show exactly what has to be labelled, what exempts you from the obligation and how to build it into the day-to-day work of a PR and marketing department.

In 60 seconds AI labelling in a nutshell

  • What the obligation involves: the audience must know that content was generated or altered by AI; this applies to deepfakes, texts on matters of public interest and website chats.
  • Who it covers: every company that publishes such content, not just the makers of AI tools.
  • Cost: mainly the team’s time for an inventory of tools, rules and training; fines for failing to label reach €15 million or 3% of turnover.
  • Starting point: a list of the places where AI creates images, recordings and texts that go out to the public.
  • Pitfall: proofreading alone is not editorial control, because only genuine verification by a responsible person exempts you from labelling.

What AI content labelling is and where the obligation comes from

AI content labelling means informing the audience that an image, audio recording, video or text was generated or substantially altered by artificial intelligence. In English this is referred to as AI-generated content, i.e. content produced by AI. The legal basis is Article 50 of the AI Act, the EU Regulation 2024/1689, which applies directly in Poland. We describe the timetable, the Polish implementing act and the other obligations in a separate article on when the AI Act applies and who it affects.

The provision has two levels. The first concerns tool providers: text, image, audio and video generators must add machine-readable markers (metadata, watermarks) to their outputs. The second concerns companies that use these tools and publish the results, so it falls to the PR and marketing department. It is about visibly labelling deepfakes and AI-generated texts on matters of public interest.

This is not legal advice. We describe the rules on the basis of public sources, as of September 2026; for a specific campaign or contract, consult a lawyer. For the bigger picture, in which labelling is just one of the topics, see our guide to AI in business for marketing and PR.

What applies from 2 August 2026

Here are the four obligations from Article 50 that affect corporate communication. The “Who it applies to” column matters more than it looks, because some obligations lie with the tool’s maker and some with the company that publishes the content.

Obligation (Art. 50 AI Act)Who it applies toWhat it means in practice
Informing people that they are talking to AIsystem providers, e.g. of a website chata chat on a company website must clearly state that it is a program, unless this is obvious
Machine-readable marking of contentproviders of tools that generate text, images, audio, videotools must add markers; systems placed on the market before 2 August 2026 have until 2 December 2026
Disclosing a deepfakecompanies that publish such contenta realistic image of a person, place or event created by AI must be labelled no later than the audience’s first contact with the material
Disclosing AI-generated text on public matterscompanies that publish such textexemption when the text has undergone genuine review by a human who takes editorial responsibility for it

What the Digital Omnibus postponed — and what it left untouched

The package of changes known as the Digital Omnibus was published on 24 July 2026 and entered into force on 27 July. The AI Act has not been suspended. The Omnibus mainly postponed the obligations for high-risk systems, to 2 December 2027, and for AI built into products covered by separate legislation, such as medical devices, to 2 August 2028.

Providers of generative tools that were on the market before 2 August 2026 were given until 2 December 2026 to implement machine-readable marking. The obligation for publishing companies to label AI content (deepfakes, texts on matters of public interest) has applied since 2 August 2026. Nothing has changed that date.

In addition, on 10 June 2026 the European Commission published the final version of the code of practice on marking and labelling AI content. It is voluntary. However, it will serve as a point of reference when assessing compliance. It allows a publicly available EU icon or an equivalent label for visual material, and a spoken notice for audio content.

What to label and what not to: typical situations in a communications department

The question that raises the most doubts is whether every graphic and every post a model helped with needs an AI label. No. The obligation covers two types of content: realistic material that could mislead people about real persons, places or events, and texts on matters of public interest without genuine human control. The table lists the situations that come up most often in a communications department’s work.

Zespół Commplace® układa zasady, wzory oznaczeń i szkolenie, a decyzję zawsze podejmuje człowiek.

Labelling AI graphics, video and AI-generated content in advertising

For a graphic, ask yourself one question: could the audience take the image for real? If so, and if the image depicts a real person, place or event, a visible notice is needed alongside the material. For evidently artistic, satirical or fictional works, the provision requires disclosure in a way that does not spoil the enjoyment of the work, for example in the end credits.

AI-generated content w reklamach podlega podwójnym regułom: prawa i platform. Jak w ogóle pracować z generatorami przy kampaniach, opisaliśmy w artykule o advertising created with AI, and where the role of the generator ends and branding begins in our article on AI graphics and logos for business.

When text written with the help of AI has to be labelled

When you publish text generated or altered by AI in order to inform the public on matters of public interest (politics, public health, the environment), and nobody has genuinely checked it or taken editorial responsibility for it. The European Commission explains that human review means a conscious assessment by a person with the appropriate competence, and editorial control means an entity that can approve, change or reject the text, including checking the facts. Correcting typos is not enough.

Jak pisać komunikaty, które chętnie cytują media i modele, pokazujemy w analizie 1,796 press releases in the age of AI, and you will find the basics of the craft in our guide, how to write a press release.

How to implement AI content labelling in a PR and marketing department, step by step

You can wrap it all up in a few weeks if you start with the facts rather than the policy document. The order matters, because without an inventory of tools you do not know what to label.

Ostatni krok, czyli regularny przegląd, idzie najsprawniej, gdy każda publikacja zostawia ślad. W Commwork®AI system widać, kto, kiedy i co zatwierdził. Bez podpisu człowieka nic nie wychodzi. Taki dziennik przydaje się też wtedy, gdy ktoś zapyta, dlaczego materiał nie miał etykiety.

  1. STEP 01Inventory of tools and publication channels

List the AI tools used in the department: what they are used for, who has access to them, what data goes into them and where the outputs end up (website, social media, adverts, media).

  2. STEP 02Sign-off rule

A text goes out only with the name of the person who checked it. Record who verified it, when and what exactly was checked.

  3. STEP 03Human in the loop

AI prepares the draft. A human decides. Internally, we call this human in the loop.

  4. STEP 04Label template

Agree on one wording for the AI label for images, video and audio (for example “Material generated with the use of AI”) and the place where it appears. The EU icon from the code of practice is a good basis.

  5. STEP 05Chat and contracts

The website chat says it is a program from the very first sentence. In contracts with agencies and freelancers, specify who is responsible for editorial control and labelling.

  6. STEP 06Training and review

Short, practical team training on the rules and risks (Article 4), with a record of who completed it. Review the rules whenever a new tool is introduced.

What it costs and what drives the budget

The label itself is free. The money goes on preparing the rules and training, and above all on the time of the people who check the content. Most depends on the number of channels and on how much visual material the company produces with the help of generators.

Skąd wiesz, że procedura działa? Ustal próg i sprawdzaj go na próbce.

Typowy dział komunikacji w 90 dni i lista kontrolna

Ten scenariusz to przykład poglądowy, nie opis wdrożenia u klienta. Załóżmy dział komunikacji z pięcioma osobami, czatem na stronie, trzema kanałami w mediach społecznościowych i kilkoma podwykonawcami, którzy dostarczają grafiki i wideo. AI Act oznaczanie treści obejmuje tu kilka miejsc naraz.

To zajmuje jedno popołudnie.

Zasady trafiają do zespołu tam, gdzie ludzie naprawdę czytają ogłoszenia; dobór kanału podpowiada tekst o narzędziach komunikacji wewnętrznej.

Miesiąc trzeci. Zespół przechodzi krótkie szkolenie, a lista uczestników zostaje zapisana jako ślad działań z artykułu 4. Na koniec ktoś spoza działu sprawdza losową próbkę publikacji według progu opisanego w sekcji o kosztach. Wynik trafia do dziennika.

Jak wygląda taki scenariusz od strony wizerunku, opisujemy w tekście o crisis in the brand's image.

When to start and which signals speed up the decision

If your company publishes AI material, the rules should be in place today, because the obligation to label AI content has applied since 2 August 2026. Speed things up if you are planning a campaign featuring AI-generated images of people, have a chat on your website, publish comments on matters of public interest (energy, health, local government) or commission content from several subcontractors at once.

Put two dates in your calendar. On 2 December 2026, the transitional period for tool providers ends, and the Komisja Rozwoju i Bezpieczeństwa Sztucznej Inteligencji (Commission for the Development and Safety of Artificial Intelligence), Poland’s AI market supervisor, is due to start operating in November 2026. A deepfake is also a crisis risk; we write about how to respond when someone impersonates your company in our article Deepfake: what it is, how to spot it and what to do. For a fuller picture of the risks, see our article on what a company using AI actually risks.

We help set up rules for working with AI in the communications department (tool inventory, sign-off, approval, training) as part of our service AI PR — public relations supported by artificial intelligence. The first conversation is free of charge. Write to us.

The most common slip-ups when labelling AI content

1
Labelling everything “just in case”

A label on every post where AI corrected a comma dilutes the meaning of labels and teaches audiences to ignore them. You lose credibility exactly where a label is really needed.

2
Treating proofreading as editorial control

The European Commission states explicitly that a superficial check is not enough. A text on matters of public interest “reviewed” in two minutes still needs a label. Failing to label it risks a fine.

3
No name on the approval

A sign-off reading “marketing team” does not show who took responsibility. In a dispute, the company cannot demonstrate human control, and in the event of an error it will not know where the process failed.

4
A realistic likeness without consent and without a label

A generated face resembling a well-known person or an employee is a problem under Article 50 and under image rights at the same time. It ends with the campaign being withdrawn, a legal dispute and a reputational crisis.

5
Overlooking subcontractors

An agency or freelancer uses a generator, but responsibility for the publication still falls on the company. Without a clause in the contract, it is hard to establish afterwards who was supposed to label the material.

Questions about AI labels that spokespeople and marketers ask us

What are the penalties for failing to label AI content?

For breaches of the transparency obligations, the AI Act provides for administrative fines of up to €15 million or up to 3% of total worldwide annual turnover, whichever is higher (Article 99(4)). For small and medium-sized companies, the lower of the two amounts applies.

Can a press release be written with AI assistance?

Yes. The rules do not prohibit the use of AI. They require transparency or genuine human editorial control. A press release checked and signed by a named spokesperson or author meets this condition.

Who in the company is responsible for labelling AI content?

Whoever publishes the content, i.e. the company as the deployer of the AI system. Within the company, appoint one person responsible for the rules and another who approves material that is sensitive from a reputational or legal point of view.

Does every AI graphic have to be labelled?

No. The AI Act obligation applies to realistic images that could mislead people about real persons, places or events (deepfakes). An illustration in a clearly cartoon style usually does not need a label, but platform terms, such as YouTube’s, may have their own rules.

What should an AI label on a graphic or video look like?

It must be clear and visible no later than the audience’s first contact with the material. The European Commission’s code of practice of June 2026 allows the EU icon or an equivalent label, and a spoken notice for audio recordings.

When does the obligation to label AI content apply from?

The obligations for companies publishing deepfakes and AI-generated texts on matters of public interest have applied since 2 August 2026. Providers of generative tools placed on the market before that date have until 2 December 2026 to implement machine-readable marking.

Is a watermark added by the generator enough?

Not always. Machine-readable marking is the tool provider’s obligation, and the audience usually does not see it at all, because the marker sits in the file’s metadata or in an invisible watermark that nobody simply watching a video or looking at a photo will notice. For deepfakes, the company publishing the material must also disclose this in a way that is visible to people.
